The District Council finds and fines fly-tipper after they leave the county

In August 2022 the offender, Florin Tudor, was fined £510 in his absence in relation to failure to attend a formal interview regarding the fly-tipping of waste in Halam. A warrant was also requested to bring him before the Court to answer allegations of environmental offences.

At Court he pleaded guilty and was ordered to pay a further £1,000 fine, £100 victim surcharge, and £878 in prosecution costs.

Tudor claimed to have paid a third party to dispose of his waste and pleaded guilty to duty of care under Section 34 of the Environment Act 1995, which requires anyone who produces waste to take all reasonable steps to ensure that waste is disposed of legally.

Councillor Roger Jackson, Portfolio Holder for Cleaner, Safer, Greener, at Newark and Sherwood District Council, said: “We are committed to creating a cleaner, safer, and greener district for all to be proud of, and this case demonstrates the time and effort our teams put in to finding offenders, wherever they may be, and making sure that they are held responsible for their actions. Just because you are outside of our district does not mean you can blight our community without consequence. Our message is clear, don't do it and we won't be after you.”

The District Council strongly advises residents to check that anyone removing their waste has the required licenses. If your waste is not disposed of legitimately, it will be your responsibility and will be considered fly-tipping. You can check the valid waste carrier’s license easily through the Environment Agency website.

Councillor Jackson continued: “If you have waste that you want to pay a third party to dispose of you must use legitimate removal services that will remove your waste responsibly and legally. We also offer a bulky waste collection service for a small charge so it’s worth checking our website for more information.”

Alternatively, residents are able to use the household waste and recycling centres.

The District Council warns that those who ignore the law and fly-tip waste could be heavily fined, and in severe cases even receive a prison sentence. If the case is taken to the Crown Court the fine is unlimited and could result in up to five years in prison.
